The Occupational Safety and Health Administration[i] requires private employers[ii] to keep injury and illness records[iii] on their employees.  To insure thorough recordkeeping, OSHA also requires employers to instruct their employees to report work-related injuries.  Employers should be careful to explain that this reporting requirement is a legal right and that they are prohibited from retaliating against those who report injuries.  Employers must therefore establish “a reasonable procedure for employees to report these work-related injuries and illnesses promptly and accurately.”  OSHA warns employers, “A procedure is not reasonable if it would deter or discourage a reasonable employee from accurately reporting a workplace injury or illness.”
